Memorandum of the Attorneys Bar to the President of the Republic:

In the name of Allah, the most Gracious &Merciful

Dear Mr. President,

Peace, mercy and blessings of Allah Almighty upon you.

The Democratic Alliance for lawyers is addressing you today on the basis of its responsibility and duty as part of its national, professional, humanitarian and ethical commitment towards the abuse and violation which has reached citizens in various parts of the country, represented in the brutal and violent processions of peaceful protests and rallies that pervaded the country. The protests began after the harsh economic measures taken recently by the government as it removed the fuel subsidy, which raised the prices of food commodities, medical treatment and the cost of transportation, in a sudden and unprecedented manner. It also lead to the decline in the Foreign exchange rate, which only instigated serious consequences on the cost of the industry, agriculture and all services. Not to mention the negative impact on investment opportunities, development and the sources of living for the citizens, particularly poor and marginalized groups that are no longer able to meet the simple living requirements of food and drink, in addition to the cost of education, medicine, clothing, transportation and increased scarcity of jobs and righteous livelihood.

Mr. President, as you know the International Bill of Human Rights guarantees the freedom of speech, rights of expression and peaceful assemblies to hear the voices of the masses, which Sudan also considers them part of the country’s constitution under Article 27 (3), and set out explicitly a number of provisions of the Constitution, which are essential in all Democratic systems. And as a number of your senior officials ensured their commitment to these rights in recent statements, with reservations, rightly so, that it does not include vandalism of public and private facilities.

Mr. President The Alliance is sure that the stormed crowds that swept across the country, in general, mainly in the triangular capital cities, did not come out to destroy or damage any buildings or facilities, and not to harm any person, not even a stone or a tree. They were mobilized in peaceful and spontaneous rallies to express their suffering, caused by the recent measures, and to protest against the government’s failure in managing its economy in scientific methods that would place the citizens’ wellbeing and dignity in its top priority, as admitted by a number of its employees. However, the official reaction to these gatherings was violent and unjustified; it did not end with abuse, slander and defamation of humble citizens, but continued and drove out forces of security, police and its special defense forces (Popular Defense), in addition to other civil forces, to overcome  the citizens; men, women, children and the elderly, with all repressive methods of steel batons, rubber bullets and tear gas which was used even inside the mosques, resulting in dozens of injuries and gas suffocation, who were not even allowed to receive aid and medical treatment at hospitals!!  In addition to force- entering University campuses, residential houses and mosques to arrest thousands of young men and women; politicians, professionals and human rights activists, some of them detained out of prison in locations unknown even to their families without filing any criminal cases against them or bringing them into police investigation or prosecution; in an explicit violation of the law, customs and the teachings of divine religions or taking them to trial as required by the most basic values ​​of justice in light of the rule of law.

Mr. President, we at the Alliance of Attorneys hereby condemn all these practices which contradict not only all international conventions but also the country’s constitution and all moral and religious values. Accordingly we request that you will intervene to take the necessary decision to immediately end the use of violence against peaceful demonstrations, and the release of all detainees, with the need to present all who have committed a felony to investigation and appear before the court, with the guarantee to ensure their right defend themselves either personally or by hiring an attorney, confirming respect towards the constitutional and legal rights to rally peacefully and the freedom of expression. Furthermore lift the ban on newspapers and all media to spread the news of what is happening in the national scene.

السيد/ رئيس الجمهوريه

السلام عليكم ورحمة الله تعالي وبركاته
يخاطبكم التحالف الديمقراطي للمحامين اليوم من منطلق مسئوليته وواجبه وإلتزامه الوطني والمهني والإنساني

والأخلاقى حول التجاوزات والإنتهاكات إلتى شملت المواطنين فى مختلف أنحاء البلاد، متمثلة فى التصدي الوحشي والعنيف للمواكب السلمية إلتي عمت البلاد عقب الإجراءات الإقتصادية القاسية التي اتخذتها الحكومة  مؤخراً برفع الدعم عن المحروقات، ورفع أسعار السلع الغذائية، والعلاجية، وكلفة التنقل، بطريقة فجائية وغير مسبوقة. فضلاً عن هبوط سعر صرف العملة الوطنية الذى عاد بنتائج وخيمة لكلفة الصناعة والزراعة والخدمات كافة، وأثر سلباً على فرص الإستثمار والتنمية، وكفالة مصادر العيش الكريم للمواطنين، خاصة الفئات الفقيرة والمهمشة إلتى ما عادت قادرةعلى  الوفاء حتى بحاجيات المأكل والمشرب، ناهيك عن كلفة التعليم والدواء والتنقل والملبس ، وضاعفت من ندرة فرص العمل وكسب العيش الشريف

السيد الرئيس
كما تعلمون، إن حقوق الرأي والتعبير والتجمع السلمي وسماع صوت الجماهير جميعها حقوق مقدسة كفلتها مواثيق الشرع الدولية لحقوق الإنسان، التى أنضم إليها السودان وأعتبرها جزءاً من دستور البلاد بموجب المادة 27(3) منه. كما نصت عليها صراحة عدد من نصوص الدستور، فضلاً عن أنها ضرورية، وغير قابلة للإنتقاص فى جميع النظم الديمقراطية. وقد أكد عدد من كبار المسؤولين منكم فى الآونة الأخيرة على كفالة تلك الحقوق، مع تحفظهم، وبحق، أن لا يشمل ذلك التخريب أو التعرض للمنشآت العامة والخاصة

السيد الرئيس
إن التحالف على يقين إن الجموع الهادرة إلتى عمت أنحاء البلاد المختلفة، بشكل عام، خاصة الأحياء فى المدن الثلاث، لم تخرج لتخرب أو تدمر أية منشآت أو مبان، أو لتلحق الأذى أو الضرر بالبشر أو الحجر أو الشجر، بل كانت تجمعات سلمية خرجت بدوافع تلقائية وسلمية، تعبيراً عن المعاناة إلتى تسببت فيها الإجراءات الأخيرة، واحتجاجاً على إخفاق الحكومة بإعتراف عدد من منسوبيها فى إدارة الشأن الإقتصادي بالطرق العلمية والعادلة التي تضع المواطن ورفاهيته وكرامته فى أعلى سلم أولوياتها. غير أن ردة الفعل الرسمية لتلك التجمعات جاءت عنيفة وغير مبررة، لم تتوقف عند حد الاساءة والقذف ومحاولة التشهير بالمواطنين المغلوب على أمرهم، بل أخرجت قواتها من أمن، وشرطة، وقوات خاصة، وما يوصف بالدفاع الشعبي، وآخرى مدنية، لتسوم المواطنين، رجالاً ونساءاً وأطفالاً وعجزة، بطشاً وقمعاً بالهروات الحديدية، والرصاص المطاطي، وقنابل الغاز المسيل للدموع الذى نشر حتى داخل المساجد، لينجم عن كل ذلك عشرات الجرحى والمختنقين بالغاز، الذين رفضت بعض المستشفيات حتى اسعافهم!! كما صاحب ذلك دخول الحرم الجامعي فى عدد من تلك المؤسسات، كما المنازل، والمساجد، لإعتقال ألوف من الشباب والنساء والسياسيين  والمهنيين وناشطي حقوق الإنسان، أحتجز بعضهم خارج السجون فى أماكن مجهولة، حتى لذويهم، بمخالفة صريحة للقانون والأعراف ولتعاليم الأديان السماوية، ذلك دون تدوين أية بلاغات جنائية ضدهم، أو التحقيق معهم أمام الشرطة أو النيابة، أو تقديمهم للمحاكمة وفق ما تقتضيه أبسط قيم العدالة فى ضوء سيادة حكم القانون

السيد الرئيس
إننا فى تحالف المحامين الديمقراطيين إذ نستنكر كل هذه الممارسات المخالفة للمواثيق الدولية، ودستور البلاد، وللقوانين وللقيم الأخلاقية والدينية، نطلب إلى حضرتكم التدخل بإتخاذ القرارات الفورية اللازمة لوقف إستخدام العنف ضد المظاهرات السلمية، واطلاق سراح جميع المعتقلين والمعتقلات، مع ضرورة تقديم كل من قام بارتكاب جناية للتحقيق والمثول أمام القضاء، مع كفالة حقه فى الدفاع عن نفسه أو بواسطة محام يوكله، تأكيداً على مبادىء إحترام الحق الدستورى والقانوني فى التجمع السلمي، وحرية التعبير، ورفع الحظر عن الصحف ووسائل الإعلام كافة فى نشر أنباء ما يدور على ساحة الوطن
